This "Roomba control" mobile Application (App) (hereinafter referred to as the "App") is developed by Guangzhou iRobot Technology Consulting Co., Ltd. Its corresponding product technology, service support, and personal information processing activities are actually provided and implemented by Shenzhen PICEA Robotics Co., Ltd. and its affiliates (hereinafter referred to as "we," "the Company," "PICEA," or "us"). We attach great importance to the protection of users' personal information and are committed to processing your personal information in a safe and reliable manner.

 

This "Privacy Policy" (hereinafter referred to as "Privacy Policy" or "this Policy") Applies to your use of iRobot smart products and related services through the App provided by us. Regardless of the country or region where you are registered or used, your personal information will be stored within the territory of the Chinese mainland and is governed by the laws and regulations of the Chinese mainland, such as the Personal Information Protection Law of the People's Republic of China.

We are committed to maintaining your trust in us and protecting your personal information. Please read and understand this Privacy Policy carefully before using our products or services. We will strictly abide by this Policy. You understand and agree that as long as you click to accept this Policy during the account registration process and complete the App account registration, or actually use our products and services, it means you agree to our collection, use, storage, and sharing of your relevant information in accordance with this Privacy Policy.

 

 I. What Personal Information We Collect

 

For your clearer understanding of this Privacy Policy, some common terms in this text are explained as follows:

-Mobile Terminal: Mobile devices running the App, such as mobile phones, tablets, etc.

-Household Robot Products: Smart hardware devices that can access the IoT platform through the App.

 

In order to provide you with our services, we will request you to provide personal information necessary to provide services to you. If you do not provide personal information, we may not be able to provide you with our products or services.

 

The basic business functions of the products and services we provide to you include:

1. All functions of your household robot products (subject to the product manual);

2. The App pairs with and controls your household robot products and records the operation of the product;

3. Communication and processing related to the operation and use issues of the App and your household robot products paired with the App.

 

We only collect information necessary for specific, clear, and legal purposes and will not further process relevant information in a manner inconsistent with these purposes. We collect the following types of information (whether they are personal information or not):

 

1. Information You Provide to Us

The App account is the prerequisite for using the App's business functions on the mobile terminal carrying the App after downloading the App, and will gather various types of data you provide and receive in the App (account avatar, nickname, feedback you provide). When you register, log in, or verify your account in the App, we will collect your mobile phone number (or email address) and account password.

 

2. Information Related to Mobile Terminal and App Operation

We may collect information related to the mobile terminal running the App, including the device model, device identifier (IMEI/Android ID/IDFA/OpenUDID/OAID), operating system and version, time zone setting information, language setting, and information of the cellular network operator used by the mobile terminal; we may also collect App crash information.

 

3. Device Information

We may collect information about household robot products bound to your account, such as: device model, MAC address, SN code, device network status (IP/network signal), OAID, Android ID (device identification of Android phones), firmware version, and MAC address information of the router.

 

4. Network Configuration and Access Information

Data collected during the network configuration process (this collection may involve the use of Cookies technology for storage so that you can view historical network configuration situations next time) are not all personally identifiable information, including:

(1) App name;

(2) Network card (Mac) address, operating system and its version;

(3) The SSID, network standard, displayed IP address, location, time zone of the same Wi-Fi network that your mobile device and your household robot are connected to, and the time when the network configuration request was sent to our server;

(4) The model, SN code, and network card (Mac) address of your household robot;

(5) Fault types during the network configuration process of your App, mobile device, and household robot.

 

5. Permissions Called by the Mobile Terminal

We will need to call the following permissions of your mobile terminal:

(1) To perform network configuration connection and App functions that require internet access, it is necessary to obtain "Network Connection Status," "Wi-Fi Information" permissions, and "Local Network" permissions. To complete network configuration more efficiently, your mobile terminal's "Location" and "Bluetooth" permissions are also required;

(2) To store App usage logs and update App versions, the "Storage" permission needs to be called;

(3) To ensure the safety of your App account, "Device Information" needs to be obtained;

(4) To push various messages related to your account to your mobile terminal, the "Notification" permission needs to be called.

 

 II. How We Use Personal Information

 

We may use your personal information for the following purposes:

1. Create and maintain your account. We collect the mobile phone number, email address, account password, account avatar, and nickname provided by you when creating an account on the mobile terminal to establish and maintain your personal account and profile page.

2. Guarantee the realization of basic functions of the App and devices. We collect your App operation-related information to ensure the realization of the basic functions of the App; we collect device information related to the account binding to ensure the realization of the basic functions of the device.

3. Device access. In the case where the device needs to be connected to the network for use, corresponding network settings need to be performed through the App. This process requires you to input the corresponding Wi-Fi name and password. You can clear the Wi-Fi name and password at any time by resetting the device and deleting the App.

4. Device status display. This allows you to remotely view the device status so that you can check the online status of the device at any time.

5. Provide push services. We use your account to perform push services through third-party SDKs to send you device notifications and system notification messages.

6. Verify user identity. The App uses a password to verify your identity to ensure that unauthorized personnel cannot log in.

7. Maintain login status. We use Token to help you maintain your login status, so you don't need to enter login account information again when you re-enter the App after exiting.

8. Collect user feedback. The feedback you choose to provide is extremely valuable for helping us improve services and assisting you in solving problems encountered during use. To track your feedback, your account name, input feedback information, mobile terminal model name, and system version will be retained on the server side.

9. Provide firmware upgrade functions. Based on the firmware version information of all devices bound through the App by your account, we will remind you to perform firmware upgrades when corresponding upgrade packages are available.

10. Improve products and services. We use your mobile terminal and App operation-related information to better improve our products and services.

11. Device communication. We use your OAID and Android ID information as a unique identifier for the App to communicate with the device.

12. App one-click login. We use the cellular network operator information of the mobile terminal carrying the App and your mobile phone IP address to provide a safe and reliable login service for App one-click login.

 

 III. How We Store and Protect Personal Information

 

1. How We Store Your Personal Information

(1) We use a unified architecture for services provided to all users. All personal information generated by you through this App (including accounts, device data, logs, etc.) will only be stored on Alibaba Cloud servers within the territory of mainland China. We will not transfer this information to servers outside the territory of mainland China.

(2) Legal basis: To ensure that your personal information is fully protected, we strictly abide by the Personal Information Protection Law of the People's Republic of China and other relevant laws and regulations.

(3) Regarding data storage and access: We only allow authorized personnel to access your personal information and strictly limit access permissions to ensure your data security.

(4) Transparency of data storage location: We have clearly listed all specific locations where personal information is stored and ensure you understand their storage locations. If you have any questions about data storage, please feel free to contact our privacy protection team, and we will provide you with further information.

 

2. Storage Duration

(1) Account information (email/mobile phone number): We will keep your account information until you actively cancel your account.

(2) Cleaning record information: Your cleaning record information will be saved for a maximum of 180 days and will be automatically deleted after that time limit.

(3) Map information: Map information will remain stored locally on the robot until you delete the map through the App or press the button to restore the robot to factory settings, at which point we will clear the map data.

 

3. Our Data Security Capabilities and Policies

We promise to make information security protection reach the security level required by laws and regulations. To ensure your information security, we are committed to using various security technologies and supporting management systems to prevent your information from being leaked, damaged, or lost. At the same time, we have established a personal information protection responsibility department, established relevant internal control systems, and adopted the principle of minimum sufficient authorization for staff who may contact with your information, strictly controlling the data access process and Approval mechanism.

 

4. Our Handling of Personal Information Security Events

Please understand that due to technical level limitations and various malicious means that may exist, personal information security events may unfortunately occur due to factors outside our controllable range. If such a security event occurs, we will timely inform you in accordance with the requirements of laws and regulations: the basic situation and possible impact of the security event, the handling measures we have taken or will take, suggestions for your independent prevention and risk reduction, remedial measures for you, etc.. We will timely inform you of event-related situations by email, letter, telephone, or push notification. When it is difficult to inform one by one, we will take reasonable and effective ways to release announcements. At the same time, we will also proactively report the handling of personal information security events as required by regulatory departments.

 

5. Our Deletion of Your Personal Information

We only retain your personal information for the period necessary for the purposes stated in this Policy and within the maximum time limit permitted by laws and regulations (whichever is earlier), and we will delete or anonymize it in a timely manner after that time limit. If we stop all or part of our services to you or stop related operations, we will timely stop continuing to collect your relevant personal information and notify you in accordance with the User Agreement (https://cn-allaiot.irobotiot.cn/prod/agreements-manage/roomba_control_app_user_agreement_en.html), and delete or anonymize the personal information of yours that we hold. We will also respond to your request to delete the personal information we have collected in accordance with applicable laws. However, we have the right to continue to retain your personal information in accordance with applicable laws (for example, regulations on the retention period of network logs), or retain your relevant personal information considering other legal relationships still existing between us and you. We will also continue to retain records of your consent to the collection and use of personal information, subsequent changes, or withdrawal of consent (we will avoid new personal information collection in such retention) to meet legal obligations and potential litigation requirements.

 

 IV. Regular Scenarios of External Provision of Your Personal Information

 

1. Overview

Normally, we will only provide your personal information externally under the following circumstances:

To provide you with the business functions described in this Policy and to collect and use personal information according to this Policy, it is inevitable to use the technology of third parties (for example, using third-party technical databases to build the technical framework of the App or your household robot). There are also some third-party services that may involve such third parties thereby learning the personal information you agree to provide to us according to this Policy (for example, storing App and your household robot data and databases on servers rented by third parties).

 

According to the last type of contact method between third parties and your personal information mentioned above, it is divided into the following categories:

It is hereby clarified that our publication of marketing information for third-party merchants in the App does not involve transmitting your personal information to such third parties.

 

Please note that the aforementioned third parties may have independent privacy policies or personal information protection policies applicable to you and may collect and use your personal information independently of the App or your device. This Policy does not apply to such scenarios and our responsibility won’t be triggered under such scenarios. If you need to know more information, please read the latest version of the privacy policies published by these third parties from time to time or contact these third parties directly. If you find that webpages created by these third parties or Applications developed by third parties are risky, it is recommended that you terminate relevant operations to protect your legal rights and interests.

 

2. Entrusted Processing

We promise you that when we entrust a third party to process personal information, we will comply with the following requirements:

(1) Require that the entrusted analysis it performs does not exceed the scope of your authorization and consent, unless it belongs to a scenario where your consent is not required;

(2) Conduct an evaluation of the data security capabilities of the entrusted processing party in advance to ensure it possesses the data security capabilities required by laws and regulations;

(3) Constrain the responsibilities and obligations of the entrusted processing party through contracts to make it comply with applicable laws and require it to comply with the obligations we owe to you at a standard no lower than ours;

(4) Accurately record and save the entrusted processing of personal information to ensure your information security and effective access to and control of your personal information via entrusted processing;

(5) When the entrusted relationship is terminated, or when we delete or anonymize your personal information according to this Policy, require the entrusted processing party to delete your personal information and destroy all data copies.

 

3. Sharing

We will only share your personal information for legal, legitimate, and necessary purposes. The shared party receiving the data has no right to use the shared personal information for other purposes beyond the scope informed to you in this Policy.

 

(1) Share your personal information as necessary to provide products and services to you:

a. We will understand and review the receiver implementers of such third parties, the content of personal information intended to be shared, sharing time, purpose of use, and relevant security measures, carry out personal information security impact assessments in advance, and take effective measures to protect personal information subjects based on the assessment results;

b. We will accurately record and save the sharing of your personal information, including but not limited to the date, scale, purpose of sharing, and the basic situation of the data receiving party, to help you understand the storage and use of your personal information by the data receiving party;

c. We will ensure your effective access to and control over the personal information already shared with third parties, such as accessing, correcting, deleting, and canceling the App account.

 

(2) Share your personal information based on mandatory requirements of laws, regulations, and regulatory agencies:

We may provide your personal information to corresponding competent authorities in accordance with applicable laws and regulations, court orders, or other legal process provisions, or mandatory administrative or judicial requirements. Information sharing in such scenarios does not require your authorization and consent.

 

4. Joint Control

We will determine the personal information security management requirements and security event handling requirements to be met with the joint control party in the form of a contract, and its standards shall not be lower than the applicable law requirements. Such joint control parties shall ensure that after obtaining personal information, they only use your personal information according to the purposes of use described in this Policy, always cooperate with you in exercising rights related to personal information, and should delete your personal information after the relevant purposes described in this Policy are achieved. We will supervise this.

 

5. Other Types of Third-Party Integration

We will determine the personal information security responsibilities and personal information security measures to be implemented with other types of third-party integrated parties in the form of a contract, properly retain relevant contracts and management records, and supervise them to strengthen personal information security management.

 

 V. Irregular Scenarios of External Provision of Your Personal Information

 

1. Transfer

Transfer refers to us losing control over your personal information while the transferee obtains control over your personal information. In principle, we will not transfer your personal information to any company, organization, or individual. If there is indeed a necessity to transfer personal information, we will carry out the transfer in accordance with applicable laws and inform you of the purpose of the transfer, the personal information involved, and the relevant situation of the transferee.

 

One possible scenario of information transfer is: as our business continues to develop, we may undergo transactions such as mergers, acquisitions, and asset transfers. If a change in the controller of your personal information or personal information sharing or transfer is involved, we will inform you of the relevant changes and any choices you may have regarding your personal information. We will also require the new company or organization holding your personal information to continue to be bound by this Policy through contracts, etc. Otherwise, we will further require the company or organization to re-obtain your explicit consent and continue to protect your personal information in accordance with laws and regulations and standards no lower than those required by this Policy, or require the data receiver to continue to protect your personal information.

 

We will handle the transfer of your personal information by referring to the aforementioned commitments regarding sharing, and inform you of the transferee's name, contact information, purpose of transfer, content of transfer, and the corresponding legal responsibilities borne by the transferee, etc., in accordance with applicable laws.

 

2. Public Disclosure

In principle, we will not publicly disclose your personal information externally. If public disclosure is indeed required, we will inform you in advance of the purpose of this public disclosure, the type of information disclosed, and the content of personal sensitive information that may be involved, obtain your explicit consent, and fulfill relevant obligations in accordance with applicable laws.

 

 VI. Your Rights

In accordance with relevant Chinese laws, regulations, and standards, we guarantee you to exercise the following rights regarding your personal information:

 

1. Access and Update Your Personal Information

You can log into your App account in the App to view the "User Information" and "Settings" interfaces, check or modify the personal information you have submitted, manage the delivery address and associated third-party accounts, or perform relevant privacy and security settings. However, for considerations of security and identification or according to mandatory provisions of laws and regulations, you may not be able to modify some initial registration information you provided during registration. If you cannot access or correct your personal information through the above methods, please request our assistance through the contact information shown in Article 9 of this Policy. We will continue to develop interfaces that are convenient for you to operate independently; please pay attention to the subsequent updated versions of the App.

 

2. Delete Your Personal Information

In the following scenarios, you can make a request to us to delete personal information:

(1) If our behavior in collecting and using personal information violates laws and regulations;

(2) If our behavior in processing personal information violates our agreement with you;

(3) If you withdraw your consent after agreeing to our collection and use of your personal information;

(4) If you no longer use our products or services, or you cancel your account;

(5) If we no longer provide products or services to you.

 

If we decide to respond to your deletion request, we will also simultaneously notify the entities that obtained your personal information from us and request them to delete it in a timely manner, unless laws and regulations provide otherwise or these entities obtain your independent authorization. When you or we assist you in deleting relevant information, because of applicable laws and security technologies, we may not be able to immediately delete the corresponding information from the backup system. We will securely store your personal information and further process and isolate it until the backup can be cleared or anonymization can be achieved.

 

3. Change the Scope of Your Authorization and Consent or Withdraw Consent

You can change the scope of your authorization and consent by requesting us to delete personal information or prohibiting the App from calling the permissions of your mobile terminal. Perform withdrawal of consent or authorization in the settings in the App (see the "Cancel your App account" process for details). After completing the above process, we may be unable to continue providing App services due to a lack of necessary information. Your withdrawal of consent or authorization does not affect the legality and effectiveness of personal information processing we previously carried out based on your consent.

 

4. Cancel Your App Account

You can request to cancel your App account through the contact information shown in Article 9 of this Policy, or via "App Settings - Me - Edit - Cancel Account" in the App. After canceling the App account, parts of your device functions that do not involve App control can still be used.

 

5. App Unbinding Device

You can delete a device by clicking the "Device Name" on the App home page. After deletion, information of the device stored in the cloud will be deleted.

 

6. Respond to Your Above Requests

Before responding to your above requests, to guarantee security, you may need to provide a written request or prove your identity in other ways. We may first ask you to verify your identity, and will process it within fifteen (15) working days after the verification is successful; for special scenarios, we will respond within at most thirty (30) days or within the time limit stipulated by laws and regulations or provide a reasonable explanation for being unable to respond in a timely manner.

 

In the following scenarios, in accordance with the requirements of laws and regulations, we will be unable to respond to your request:

(1) Directly related to national security and national defense security;

(2) Directly related to public safety, public health, and major public interests;

(3) Directly related to criminal investigation, prosecution, trial, and execution of judgment, etc.;

(4) There is sufficient evidence that you have subjective malice or abuse of rights;

(5) Responding to your request will cause serious damage to the legal rights and interests of you or other individuals or organizations;

(6) Out of maintaining the life, property, and other major legal rights and interests of you or other individuals but it is difficult to get your own authorization and consent;

(7) Involving trade secrets;

(8) Related to our fulfillment of obligations stipulated by laws and regulations.

 

 VII. Special Provisions for Personal Information of Minors

We attach great importance to the protection of minors' personal information. We will not actively collect personal information directly from minors. Regarding the collection of minors' personal information with the consent of the guardian, we will only use, share, transfer, or disclose it when permitted by law, with the consent of the guardian, or as necessary to protect the minor. We expect parents or guardians to guide minors in using our services. If you are under 14 years old, or are a minor according to the laws and regulations of your location, it is recommended that you ask your parents or guardians to read this Policy and use our services under the premise of obtaining the consent of your parents or guardians, but please avoid providing us with any personal information that can identify you personally. If your guardian does not agree to your use of our services in accordance with this Policy, or you actually provided us with information that can identify you personally, please immediately terminate the use of our services and inform us timely so that we can take corresponding measures in accordance with the provisions of applicable laws.

 

 VIII. How This Policy is Updated

Our Privacy Policy may change. When the terms of this Policy change, we will show you the updated Privacy Policy in forms such as push notifications during your login and version updates. For major changes (changes in business functions, outbound situations, purposes of use, contact information, etc.) or changes that may increase your responsibility, we will also provide more significant notifications (including but not limited to emails, SMS, or special prompts on browsing pages to explain the specific changes of this Policy).
